Shopping in Paris Competition ("Competition")
Terms and Conditions

• Information on how to enter and the prize forms part of the terms and conditions of entry. Participation in the Competition is deemed acceptance of these terms and conditions and any other notices referenced herein.
• The promoter is French Tourist Bureau ABN 57 145 096 126 of Level 13, 25 Bligh Street, Sydney NSW 2000, ("Promoter").
• The sponsors are the French Tourist Bureau, Air France (together the "Sponsors").
• Subject to paragraphs 5 and 6 below, entry is only open to residents of Australia ("Entrants").
• Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter the Competition.
• Employees (and their immediate family members) of the Promoter, the Sponsors and any of their associated agencies (including, without limitation, Atout France), suppliers or related bodies corporate are not eligible to enter this Competition.
• The Competition commences on Monday 08th August 2011 at 00:00:01 (AEDT), except for Victorian residents where the competition will start on the 12th August 2011.The competition concludes on Friday 16th September 2011 at 23:59:59 (AEST) ("Competition Period"). No responsibility is accepted for late, lost or misdirected entries.
• To enter the Competition and to be eligible to win the prize Entrants must, during the Competition Period:
  • a. access http://www.shoppinginparis.com.au and register their details including, without limitation, name and e-mail address. Failure to provide the requested information will render the entry invalid; and
  • b. answer 3 multiple-choice questions; and
  • c. otherwise comply with these terms and conditions ("Competition Entry").
• Upon successful completion of the Initial Entry, the Entrant will be given the opportunity to refer up to three (3) friends to the Competition. The friend referred by the Entrant will receive an email containing a hyperlink to the Competition which will invite the friend to enter the Competition. The Entrant will receive one additional entry ("Additional Entry") for each friend referred provided that the referred friend:
  • a. has not already entered the Competition – where this occurs, the Entrant will not receive an Additional Entry; and
  • b. has not already been referred by another person – where this occurs, only the person to first refer the friend shall receive the Additional Entry. For the avoidance of doubt, if the referred friend has already participated in the Competition, the referred friend will not be able to participate again.
  • c. The entrant must have their friends' consent to be able to refer their friends and provide their email addresses.
• Entrants may only submit one Competition Entry during the Competition Period. The Entrant will receive one additional entry ("Additional Entry") for each friend referred subject to conditions in section 9, 9a and 9b.
• Entries will be deemed to be accepted at the time of receipt of the Competition Entry and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. If an Entrant's contact details change during the Competition Period, the Entrant must promptly notify the Promoter of the relevant change. A request to access or modify any information provided in an entry should be in writing and directed to Promoter.
• There is one prize to be awarded in the Competition. The prize winner will be drawn at random from the pool of eligible Entrants who have submitted a correct and complete entry during the Competition Period. The draw will take place at the offices of the French Tourist Bureau of Level 13, 25 Bligh Street, Sydney 2000, on Tuesday, 23rd September 2011 at 10:00 (AEDT).
• The first correct entry of an eligible Entrant drawn will be awarded the prize which comprises:
  • a. Return Economy Class airfares to Paris for two people departing from the nearest of the following cities to the prize winner's place of residence: Sydney, Melbourne, Brisbane, Adelaide or Perth ("Flight Departure Cities"). The airfares included in the prize are subject to the Flight Terms & Conditions set out at the end of these terms and conditions, and any other terms or conditions imposed by the airline.
  • b. 3 nights' accommodation at HOTEL BEL AMI 7/11 rue St-Benoît – 75006 Paris – France, or, if not available, 3 nights' accommodation in Paris at a 4 stars hotel selected by the Promoter; The accommodation included in the prize are subject to the Accommodation Terms & Conditions set out at the end of these terms and conditions; and
  • c. 1 gift certificate from the Galeries Lafayette of a total value of $1,500 AUD. When redeemed, a Galeries Lafayette Gift Certificate is valid for 2 years. (Except on items marked with a red dot, services, food, books, records and Louis Vuitton products). A Galeries Lafayette Gift Certificate is not replaceable in case it is lost or stolen. A Galeries Lafayette Gift Certificate is not redeemable for cash. The gift certificate is valid only in the Haussmann store in Paris. To redeem your gift certificate please contact the Galeries Lafayette by email or phone. Contact number will be given directly to the winner.
• If a winning entry is deemed by the Promoter not to comply with the conditions of entry, the entry will be discarded and a new winner of the prize will be determined from those entries eligible to receive the prize.
• The prize winner will be notified by email within 2 days of the draw advising them of their prize. Notice of the prize winner will also be published on http:www.franceguide.com on the 30th of September 2011. An article will be published in the 'public notices' of "The Australian" newspaper on the 30th of September 2011.
• The winner and his/her travelling companion must depart on the same date from the same airport on the same flight. The winner and his/her travelling companion must depart Paris to return to Australia on the same date from the same airport on the same flight. Subject to paragraph 17 below, the winner and his/her travelling companion are responsible for transport to and from their nearest Flight Departure City.
• If the winner resides in Tasmania, the ACT or the Northern Territory, the winner and his/her travelling companion will be responsible for obtaining appropriate transport to the winner's nearest Flight Departure City will be. For the avoidance of doubt, such transport to the nearest Flight Departure City does not form part of the prize and the prize winner must pay all costs in connection with the connecting transport.
• The total prize value is up to AU$7,000 (including GST). Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
• The total prize must be booked and ticketed, and travel must have commenced, by 23:59:59 (AEST) on 16st of September 2012. The prize is not available during peak times such as public holidays and school holidays (if applicable), is subject to hotel and flight availability and cannot be changed once the booking has been made.
• If for any reason whatsoever the winner is unable to take any element of the prize in the time period specified by the Promoter, then that element of the prize in its entirety will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
• The prize, in whole or in any part, is not transferable to another individual and is not exchangeable or redeemable for cash, goods or services. The prize is not refundable and cannot be upgraded. The prize winner cannot change, vary, substitute or extend any element of the prize (in whole or in part) and the prize winner must be among the travelers.
• The Promoter, the Sponsors and their associated agencies, and other contractors associated with this Competition, accept no responsibility for prizes, prize information or for tickets lost in transit.
• The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
• The prize winner and his/her travel companion are responsible for all other expenses including, without limitation, spending money, meals, transfers (including from the airport of the arrival city to the hotel), activities (unless specified), incidentals, taxes, surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
• Accommodation selection, location and room type and air carrier selection and flight routing is at the sole discretion of the Promoter and the Sponsors.
• The travelers must ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveler/s.
• The Promoter and the Sponsors make no representation as to the safety, conditions or other issues that may exist at any destination.
• To the extent permitted by law and any direction of the relevant gaming authority, if the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
• If the prize winner is under 18 years of age, the prize will be awarded to the winner's parent or legal guardian on their behalf.
• An unclaimed prize draw will take place at the offices of the French Tourist Bureau, Level 13, 25 Bligh Street, Sydney 2000, on Friday 23th December 2011 at 10:00 (AEDT). The prize winner will be notified by email within 2 days of the draw advising them of their prize. Notice of the prize winner will also be published in the Public website http:www.au.franceguide.com on Tuesday, 29th December 2011. An article will be published in the 'public notices' of "The Australian" newspaper on the 30th of December 2011.
• The decision of the Promoter in relation to the conduct of the Competition and the prize winner is binding and final and the Promoter and the Sponsors will not enter into any correspondence regarding the Competition result.
• The Promoter reserves the right to require the prize winner to provide proof of identification and/or proof of residency or address details in order to claim the prize. Proof of identification, residency and address considered suitable for verification is at the discretion of the Promoter. If the prize winner cannot provide suitable proof, the prize winner will forfeit the prize in whole and no substitute or cash will be awarded in lieu of the prize.
• The Promoter reserves the right to disqualify any entry which, in the opinion of the Promoter, contains objectionable content, profanity, potentially insulting, or defamatory statements or if the entry does not comply with these Terms and Conditions. The Promoter also reserves the right to, in its sole discretion, disqualify any Entrant whom the Promoter believes has tampered with the entry process or has engaged in conduct in relation to the Competition that the Promoter believes to be fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter.
• The prize winner must comply with all the conditions of use of the prize and the prize supplier's requirements. The prize winner and his/her travelling companion may also be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
• To the extent permitted by law, no responsibility will be accepted by the Promoter, the Sponsors, their related bodies corporate, employees, associated agencies or suppliers to the Promoter (together the "Parties") for any late, lost or misdirected entries or for any claim arising from the conduct of the Competition. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the Entrant cannot be contacted during business hours on the relevant dates.
• To the extent permitted by law, the Parties will not be liable for any for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, misadventure, accident, personal injury, death, damage or claim which is suffered or sustained (whether or not arising from any person's negligence) in connection with:
  • a. any travel connected with the Competition or any prize won;
  • b. any act or omission (whether negligent or not) of the Parties, or any person associated with any of them; or
  • c. any circumstances outside the Parties' reasonable control.
• To the extent permitted by law, if for any reason this Competition is not capable of running as planned, due to causes beyond the control of the Promoter, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the competition, and recommence it from the start on the same conditions subject to any government regulation.
• In the case of the intervention of any outside person or event which changes the result or prevents or hinders the determination of the Competition, including but not limited to vandalism, power failures, tempests, acts of terrorism, natural disasters, civil unrest, strikes or any other event beyond the control of the Promoter; the Promoter may in its discretion cancel, terminate, modify or suspend the Competition and recommence it from the start on the same conditions subject to any government regulation.
• All entries become the property of the Promoter. To facilitate participation in the Competition, the Promoter may disclose an Entrant's personal information to other companies associated with this promotion. If the information requested is not provided, the individual may not enter this promotion. By entering the Competition, unless otherwise advised, each Entrant acknowledges and agrees that the Promoter and the Sponsors collecting the Entrant's personal information and enter same in a database, and the Entrant consents to the Promoter and the Sponsors using such information for future promotional and marketing activities including, without limitation, sending the Entrant electronic messages, and for any media and publicity purposes in any media worldwide without any further reference, payment or other compensation to the Entrant.
• By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
• In consideration for the Promoter awarding the prize to the prize winner, the prize winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created in connection with the prize winner's participation in any aspect of the prize ("Works"). The prize winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the prize winner will not be entitled to any fee for such use.
• Entrants' personal information may also be disclosed to State and Territory lottery departments or to another government authority, as required by law. A request to access, update or correct any personal information should be directed to the Promoter or the relevant Sponsor.
• The benefiting parties are the French Tourist Bureau of Level 13, 25 Bligh Street, Sydney NSW 2000 (ABN 57 145 096 126), Air France of Level 13, 115 Pitt Street, Sydney NSW 2000 (ABN 46 946 036 913).

Flight Terms and Conditions

• Ticket(s) won may be utilized in any season, but travel is subject to availability. It is appreciated that you give us at least 7 working days prior notice of the intended travel date, but we suggest booking your travel date as early as possible to ensure availability.
• Ticket must be issued before 16 September 2012.
• Travel between Australia and Singapore is to be on the services of Qantas based on Economy Class travel and subject to "Q" Class availability
• Travel between Singapore and Europe is to be on the services of Air France, based on Economy Class travel and subject to "T" Class availability.
• Validity of the ticket(s) is 6 months from the date of departure and all tickets are to be used together, on the same travel date.
• You can depart from any of the following cities: Sydney, Melbourne, Brisbane, Adelaide or Perth.
• Date change permitted once ticket is issued or part used within the 6 months' change for a fee of AUD 150.
• Air France prize winner's tickets are not transferable, not cash-redeemable, non-upgradeable and their validity cannot be extended. (The winner of the ticket(s) must be among the travelers)
• All flight associated taxes are included in the prize.
• Any surcharges, and additional costs are not included in the prize and are at the Prize Winner's own expense and responsibility (luggage related).
• Frequent flyer points will not be awarded on this airfare.

Accommodation terms and Conditions

• No exchange of Prize: A Prize can be transferred to a person 18 years or over at the absolute discretion of the Promoter. However, it cannot be exchanged or redeemed for cash. If for any reason, a Prize Winner cannot take any component of the Prize and he/she does not wish to transfer the Prize, then the Prize will be forfeited.
• Number of people: Room for two adults
• Ancillary Costs: All transport, meals, beverages, spending money, insurances, service charges, taxes, transfers and ancillary costs, including cost of travel to and from the property are not included in a Prize unless specified and are the responsibility of the Prize Winner.
• Taxes: If a Prize or receipt of it incurs a tax liability, the Prize Winner is liable for payment of such tax.
• Prize Availability: All components of the Prize, including accommodation are subject to availability, based on a limited allocation of rooms and may not be available during school holidays, holiday weekends or special events. In the event that any component of a Prize is unavailable for any reason, subject to State legislation, the Promoter reserves the right to substitute that Prize component with another prize of equal value and the Prize Winner will be notified accordingly.
• Date prize to be taken: Prize is valid for travel for 12 months from date of draw, excluding special event periods and public holidays (eg, New Year's Eve, Christmas etc.).
• Other: Meals and transfers are not included

By participating in the promotion, an Entrant also acknowledges that a further primary purpose for collection of the Entrant's personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact the Entrant in the future with information on special offers or to provide the Entrant with marketing materials via email. The Promoter may share information with its Australian related companies or promotional partners (including Air France) who may contact the Entrant with special offers in this way. By entering the promotion, an Entrant acknowledges and agrees that the Promoter may use the Entrant's personal information in the manner set out in this condition.
